Alan Brown has twenty-five years of experience in private practice assisting government contractors and subcontractors.   Mr. Brown concentrates his practice on government contract law and litigation, including contract claims; cost allowability, cost allocation and Cost Accounting Standards; defective pricing; data rights; foreign military and commercial sales; contract terminations; bid protests; subcontract negotiations and disputes; and various contract administration issues.  He also assists in corporate transactions involving government contractors, addressing novation, cost accounting, and other issues arising from mergers and acquisitions.  Mr. Brown is experienced in fraud and integrity issues including qui tam litigation under the False Claims Act, as well as suspension and debarment.  He has litigated before the Court of Federal Claims, the federal district courts, the boards of contract appeals, and various federal courts of appeals.

Prior to entering private practice, Mr. Brown was a trial attorney in the Frauds Section and Commercial Litigation Branch of the U. S. Department of Justice Civil Division, where he received an Attorney General’s Special Commendation Award. 

From 1990-1992, Mr. Brown served as Chair of the Council on Procurement Policy of the United States Chamber of Commerce.  In that capacity, he drafted the 1992 legislation that overturned the Grumman Aerospace decision regarding certification of contractor claims, and that restored the jurisdiction of the Court of Federal Claims over nonmonetary contract disputes.  He is a longstanding member of the American Bar Association Section of Public Contract Law, where currently he is the Vice Chair of the Accounting, Costs and Pricing Committee, and has previously served as Chair of the Federal Procurement Division, the Procurement Fraud Committee, and the Access to Information and Audit Committee.  He is also a member of the Section of Health Law, and of the Section of Business Law.

Mr. Brown received a B.A. in Government and Internatio­nal Relations from the University of Notre Dame in 1974.  He received his J.D. in 1977, with high honors, from the George Washington University Law Center, where he was a member of the Law Review and the Order of the Coif.  While a law student, he served as a Research Assistant in the law school’s Government Contracts Program.  In that capacity, he prepared course manuals on various Government Contracts topics and assisted in preparing the third edition of R. Nash & J. Cibinic, Federal Procurement Law.
